Key takeaway

Hackney is terraces and conversion. The Victorian housing has been sub-divided very heavily, so a project in one house frequently has several adjoining owners, each entitled to their own surveyor and their own award if the case is in dispute. Rear and side extensions run into shallow gardens where the boundary is close, and section 6 excavation often joins section 2 work on the same project.

If a notice has arrived and you own a flat in a converted house or block, the position is usually stronger than people assume: in a dispute the Building Owner pays the reasonable fees of both sides' surveyors.

What Hackney cases turn on

The Hackney terrace and the multi-owner problem

The Victorian terraces across Hackney, Dalston, Stoke Newington, Clapton and London Fields have been divided into flats on a large scale. A loft conversion at the top of a converted house can mean notices to the freeholder and to leaseholders below or beside the work, and each flat whose demise touches the party structure can be a separate adjoining owner.

The count decides the number of notices, the number of schedules and the realistic fee. It is the first job on any Hackney project, and getting it wrong is the most common avoidable delay.

Shallow gardens and section 6 excavation

Rear and side extensions run into shallow gardens where the boundary wall is close. New foundations frequently land within three metres of a structure older and shallower than the drawings allowed for, which is section 6 work as well as section 2 where the party wall itself is altered.

The Schedule of Condition should cover the neighbour's drainage, damp and existing movement before excavation. Those are the issues that most often turn into claims.

Shoreditch, Hoxton and the warehouse conversion

Around Shoreditch and Hoxton the stock changes to warehouse and commercial conversions. The party structure is more likely to be a floor, a frame or a shared service riser than a brick wall, and the adjoining owner is often a company rather than an individual.

Works to a separating floor, common parts or the frame can be notifiable even where no brick wall is touched. We check the lease and the title before serving.

What catches people out in Hackney

  • Count the flats first. A converted Hackney house can put several separate interests against one party structure, each entitled to notice.
  • Treat shallow gardens as a section 6 risk. The three-metre test can be met sooner than the drawings assume.
  • Look at the structure, not just the wall. In warehouse conversions, separating floors and frames are party structures under the Act.
  • Record the existing condition in detail. Older terraces have plenty of pre-existing movement. A dated schedule separates old defects from new damage.

For the underlying law, the Party Wall Act explained sets out the framework. Our party wall notice guide, schedule of condition guide and party wall award guide cover the three documents every case runs through.

Fees for party wall work in Hackney

Fixed and published: £165 + VAT per adjoining property to serve notice, £620 + VAT per Schedule of Condition, and £350 + VAT per adjoining property for an award acting for the Building Owner. A one-neighbour dispute — notices, one Schedule of Condition and the award — is £1,135 + VAT. All prices exclude VAT at 20%.

Basement and underpinning works are priced differently. Deeper excavation, more engineering input and more extensive schedules put them outside the fixed figures above. We review your plans and the proposed works first, then present a formal written quote before anything is agreed or any notice is served.

Hackney party wall questions

Do I need a party wall award to convert a Hackney terrace into flats?

Usually yes, and often more than one. The conversion will normally involve the party wall, floors and roof, and each neighbouring flat whose demise touches the work can be a separate interest. The freeholder or management company may also be an adjoining owner.

How many notices does a loft conversion in Hackney need?

One per adjoining owner. In a converted house that can be several, because each leaseholder whose flat touches the party structure may be an adjoining owner. We check the title before serving.

My neighbour in Shoreditch is altering a separating floor. Is that party wall work?

It can be. The Act covers separating floors and structural frames as party structures, not just walls. Works to a floor, common parts or the frame can be notifiable even where no brick wall is touched.

What does a party wall surveyor cost in Hackney?

£165 + VAT per adjoining property to serve notice, £620 + VAT per Schedule of Condition, and £350 + VAT per adjoining property for an award acting for the Building Owner. A one-neighbour dispute is £1,135 + VAT. Basement and underpinning work is quoted separately.
