Key takeaway

Newham is where regeneration and older housing meet. Stratford, Forest Gate and Manor Park have substantial Victorian and Edwardian terraces, much of it converted and extended to the rear. Alongside that, the Royal Docks, Canning Town and Stratford have seen large-scale new build, where party structures are modern and the risk sits in the excavation and sequencing.

If a notice has arrived and you own a flat in a converted house or block, the position is usually stronger than people assume: in a dispute the Building Owner pays the reasonable fees of both sides' surveyors.

What Newham cases turn on

Forest Gate, Manor Park and the Victorian terrace

The Victorian and Edwardian terraces in Forest Gate, Manor Park and East Ham have been converted and extended on the same pattern as Waltham Forest and Hackney. A rear extension or side return runs into a shallow garden, and the party wall is usually altered.

Where the house has been divided into flats, each leaseholder whose demise touches the work can be a separate adjoining owner. The notice count decides the fee and the timetable.

Stratford, Canning Town and the regeneration site

Around Stratford, Canning Town and the Royal Docks, large-scale new build and commercial-to-residential conversion have put modern structures against older boundaries. The party structure may be a frame or a separating floor, and the adjoining owners are often institutional.

On new-build boundaries the structure is well documented and the risk sits in the excavation and sequencing. On the Victorian terraces it sits in the condition of a wall that was never designed for what is now being done to it.

Section 6 and the new-build boundary

Excavation for a new building close to an existing structure can be section 6 work even where there is no shared wall. The three-metre and six-metre tests apply, and the Schedule of Condition on the older building is the evidence that matters if damage is alleged.

These cases need a structural review and a schedule taken before the ground is opened. Basement and underpinning work is quoted separately from the fixed fees.

What catches people out in Newham

  • Count the flats first. A converted Forest Gate or Manor Park house can put several separate interests against one party structure.
  • Treat new-build boundaries as section 6 work. Excavation close to an existing structure can be notifiable even without a shared wall.
  • Record the older building before work starts. On regeneration sites, the schedule is the evidence that matters later.
  • Check the lease in converted blocks. A party wall award does not replace landlord consent or the lease terms.

For the underlying law, the Party Wall Act explained sets out the framework. Our party wall notice guide, schedule of condition guide and party wall award guide cover the three documents every case runs through.

Fees for party wall work in Newham

Fixed and published: £165 + VAT per adjoining property to serve notice, £620 + VAT per Schedule of Condition, and £350 + VAT per adjoining property for an award acting for the Building Owner. A one-neighbour dispute — notices, one Schedule of Condition and the award — is £1,135 + VAT. All prices exclude VAT at 20%.

Basement and underpinning works are priced differently. Deeper excavation, more engineering input and more extensive schedules put them outside the fixed figures above. We review your plans and the proposed works first, then present a formal written quote before anything is agreed or any notice is served.

Newham party wall questions

Do I need a party wall notice for a rear extension in Forest Gate?

Usually yes. The new foundations will normally be within three metres of the neighbouring structure, which is section 6 work, and the shared wall may be altered, which is section 2. Each neighbour is a separate adjoining owner.

My neighbour is building a new block next to my house in Canning Town. What notice applies?

Excavation within three metres of your structure and deeper than your foundations is section 6 work, and the wider six-metre case may also apply. A new wall on the line of junction can be section 1 work. The structural drawings and the position of the new building decide.

Who is the adjoining owner in a converted Newham house?

The freeholder and any leaseholder whose flat touches the party structure can be separate adjoining owners. Tenants are not. We check the title before serving because a notice to the occupant alone is not enough.

What does a party wall surveyor cost in Newham?

£165 + VAT per adjoining property to serve notice, £620 + VAT per Schedule of Condition, and £350 + VAT per adjoining property for an award acting for the Building Owner. A one-neighbour dispute is £1,135 + VAT. Basement and underpinning work is quoted separately.
